Los Angeles -- Japanese entertainment company Toho Co. Ltd. hit New Orleans Lager & Ale Brewing Co. LLC with a lawsuit in Louisiana federal court Friday, saying NOLA’s “Mechahopzilla” beer violates Toho’s copyrights for the famed Japanese monster Godzilla's mechanized counterpart Mechagodzilla.
Toho claims NOLA unlawfully attempted to take advantage of the popularity and public recognition achieved by Toho’s fictional characters for the purpose of attracting attention to itself and its beer brand. copyrights for a character are a weak defense. trademark is a better way to protect characters that look a certain way.
